It is commonly believed that Congress-critters cannot be arrested while Congress is sitting. The facts are that they cannot be arrested for minor things like speeding, failing to pay fines, etc., but they can be arrested for felonies.
The crimes covered in the memo almost certainly reach the level of felonies.
